Professional Comments: More studious than judicially adept.  Sadly dishonest, which compromises the studious propensity on occasions where Crown or powerful interests are at stake.  At the Supreme Court this means most of the time.

Owes her appointment and advancement to being a bureaucratic functionary who kept her head low and frequently said ‘yes’ to political powers.  Bench performance in High Court was analogous to a fish out of water.  Was often intimidated into making poor decisions and losing control of proceedings.  Rapidly kicked upstairs to the Court of Appeal where, in contrast to the High Court, regularly sitting next to two experienced judges brought some maturity and confidence.  In France’s case her malleability was an asset to promotion.

Justice France is perhaps the best example of an egocentric court hierarchy promoting a weak and malleable political hack who is unlikely to pose a threat to her strong-willed colleagues whims.  Her often rash willingness to act dishonestly without much prompting to protect parochial interests has made her a much relied upon but not particularly respected judicial colleague.

In a country where the judicial appointment process is routinely opaque, Ms France’s rise still mystifies many.

Background / Education: Has an LLB (Hons) from Auckland University and an LLM from Queen’s University, Ontario.

Before being appointed to the High Court in April 2002 Ellen France was a senior legal adviser in the Department of Justice Law Reform Division; Crown Counsel and then Deputy Solicitor-General in the Crown Law Office.  She was appointed to the Court of Appeal in June 2006.  Deeply involved in the bureaucracy of politics.
