|Professional Comments:||In intellectual property litigation Assciate Judge Warwick’s work has seen a particular emphasis on trade mark and passing off disputes, domain name and Internet issues, and copyright disputes. His arbitration work includes international appointments as a Panelist for the World Intellectual Property Organisation, deciding disputes over domain names and on a number of occasions he has been appointed by WIPO to chair international panels handling such disputes. He is also one of WIPO’s arbitration “neutrals”, available to act as arbitrator in disputes arbitrated under the WIPO Arbitration Rules.Warwick Smith is an arbitrator and barrister with 35 years’ experience, specialising in intellectual property, construction, and general commercial arbitration and litigation.Member of World Intellectual Property Organisation’s panel of arbitrators. “Principal Arbitrator” appointed by the New Zealand Dispute Resolution Centre, and member of the Dubai International Arbitration Centre’s panel of arbitrators. Member of New Zealand Law Society’s Intellectual Property Committee. Member of the New Zealand Committee, Intellectual Property Society of Australia and New Zealand.
Smith AJ has had 2002 and 2001 Articles published in the New Zealand Intellectual Property Journal on anti-dilution protection for famous trade marks.
|Background / Education:||Neill & Devereux in Dunedin, where he started as a law clerk.In 1976, Smith relocated to Auckland and joined Earl Kent Massey Palmer & Hamer, where he remained until 1979 when he left to take up a position as an Associate with Alexander Bennett Warnock & Mellsop. He became partner in 1981, leaving in 1989 to join Chapman Tripp.Since 2000 Associate Judge Smith has been practising as a barrister sole, specialising in intellectual property and general commercial litigation as a member of Bankside Chambers in Auckland.
In 2008-2009 Associate Judge Warwick Smith spent a year in London completing a LLM course at the University College of London.
